Kwaan RB Construction and Facilities Services, LLC

Kwaan RB Construction and Facility Services, LLC (KRBCFS) is a newly formed, 8(a) certified, construction company and is a subsidiary of the Kake Tribal Corporation (KTC), an Alaska Native Village Corporation (ANC), located in rural South East Alaska that focuses on the federal construction industry in the lower 48 United States.  As an ANC located in both a HubZone and an Economic Opportunity Zone, KTC and its subsidiary companies are eligible for 8(a), DBE, SDBE and Hubzone designation.

Although formed in 2020, KRBCFS has the resources, infrastructure and experience of its parent company, affiliated ANC subsidiaries and their long term partner companies.  Our multi-disciplined staff has over 75 combined years of experience running projects from start to finish. Our goal is to maximize your investment. We are able to perform all types of construction projects from vertical ground up new construction, facility renovations along with all types site and civil work and everything in-between.  With being in the early stages of the 8(a) program, we will also be able to perform any Specialty Trade NACIS Codes as required.

Kwaan RB Construction and Facility Services hires qualified Project Managers. PM must have ability to oversee a project, interact with federal agencies and the public, to maintain the safety of the general public while permitting the efficiency of every project, minimizing or eliminating any operational impact to businesses and other adjacent areas. PM must have American Red Cross CPR and First Aid training, Confined Space, and Construction Management Certification.

Based on the type of project and its location, Kwaan RB Construction and Facility Services, LLC executes construction projects with pre-selected regional subcontractors to expand it’s geographical reach and presence.

RB Construction Company (RBC)
KTC, KCON and its newly formed affiliate KRBCFS have recently joined into a mentor protégé relationship to pursue the Midwest federal construction market. Using both KCON current 8a status, KRBCFS pending 8a status and RBC, KTC’s combined team construction capabilities and ANC contracting advantages will allow KRBCFS to rapidly respond to its current and future federal client requirements. RBC’s staff have extensive experience in the construction industry. Key management personnel have worked on some of the most high profile and technically demanding facilities nationwide. RBC has successfully performed and completed over $100,000,000 in federal contracts.  Examples of these types of projects include:

KTC recently into a 3-year teaming agreement with CONAM Construction for construction and facility service projects associate with the COEUR Alaska Kensington Mine located in Juneau, Alaska.  CONAM is a subsidiary of Quanta Services, Inc., a large S&P 500 energy infrastructure company serving North America, South America, Europe and Australia. KTC’s experience in construction and facility services related projects at the gold mine dates back over 25 years and involve over $50 Million in revenue. 

James Dean Construction (JDC), Inc.
In North west United States, for Kake Tribal Corporation and its subsidiaries,  James Dean Construction (JDC), Inc. as its teaming partner / sub-contractor. Has performed federal projects in the states, Oregon, Washington and Alaska to include the Tongass, Olympic, Gifford Pinchot, Mount Baker/Snoqualmie, Mt. 3 Hood, and Willamette National Forests as well as Mt. St. Helens National Monument and Mt. Rainer National Parks. JDC projects included dam removals to bridge maintenance and therefore complement Kwaan Construction’s workforce and experience in Southeast Alaska. JDC is a mid-sized horizontal construction company with specialty equipment such as a crushing spreader, a 70 metric ton excavator, articulating haul trucks and a $10,000,000 bonding capacity. Jeffrey J. Dean has over 25 years of construction experience and a Civil Engineering Degree from Washington State University. Jeff has been the Project Manager on projects of over $25,000,000. He has worked in Hawaii, Alaska, Oregon and Washington constructing quality, safe, on time and on budget projects.

Safety & Quality Control

Kwaan RB Construction and Facility Services (KRBCFS) Safety Program is dedicated to an injury free workplace. Safety does not “happen”, it requires a dedicated, proactive approach to ensure that the job site environment is free of potential hazards. We have an extensive, detailed, Safety Manual that enforces a drug free work environment and demands a working knowledge of the hazards that may be faced within the workplace. A copy of our manual is available upon request to all of our project stakeholders and related governing agencies. We continually audit our program and add new practices in response to new technology and/or modified methods and procedures. We also develop a “site specific” safety plan to meet any unique requirements or potential project concerns.

KRBCFS stresses communication both prior to and during the project. Safety is a part of each trades pre-construction/pre-task meeting, working in concert with the weekly jobsite toolbox safety meetings between their safety officer and the on-site trades. These meetings ensure that potential hazards are identified and addressed prior to the start of each day’s work. Our clients and all other project stakeholders receive clear and concise safety communications throughout all levels of the project. Also, all local, state, federal and client safety program requirements are addressed to ensure a safe and compliant workplace.

On our sites there is a zero tolerance for unsafe work activities. We work diligently in a collaborative process to maintain a safe work environment for everyone.

Alaska Native Corporations (ANC) Key FAR Facts – Questions & Answers

1. Is your government agency authorized to procure sole source contracts to an ANC 8(a) firm?

YES The authorization to sole source to an ANC is found in FAR subpart 6.3 – Other Than Full and Open Competition.

Clause 6.302-5(2) states that: Full and open competition need not be provided when (i) a statue expressly authorizes or requires that an acquisition be made through another agency for from a specified source…Authority to pursue a sole source award falls under ‘statutes that expressly authorize’ other than full and open competition. Clause 6.302-5 goes on to describe statutes that authorize sole sourcing to an ANC. The pertinent portion of the clause is 6.302-5(b)(4). This clause states that sole source awards under the 8(a) program are considered statutorily authorized.

2. Is contracting with and ANC 8(a) fast and easy?

YES  ANC 8(a) firms are eligible to receive sole source awards up to $100 million.  ANC 8(a) contracts are designated to aid Small Disadvantaged Business firms and allow a Program Manager (PM) the sole discretion to choose a specific contractor team for his or her tasks.  ANC 8(a) contracting saves substantial work and time throughout the procurement cycle.  All that is needed by the PM is a Statement of Work/Statement of Objectives, along with the choice of the ANC 8(a) entity with the expertise needed, submitted to that ANC’s Small Business Administration (SBA) representative and the project will be set aside.  This must occur prior to, and in lieu of, advertisement of solicitation for competition.

3. Is there a contract size restriction when sole sourcing to an ANC?

NO  The competitive threshold for other classifications of 8(a)’s is $5,000,000 for manufacturing contracts and $3,000,000 for all other types of procurements.  Above this amount, requirements must be competed among qualified 8(a)’s.  As stated in the excerpt below from 13 C.F.R. § 124.506, ANC’s are exempt from the solely owned competitive threshold therefore $100 million applies to ANC sole source awards.

(b) Exemption from competitive thresholds for Participants owned by Indian tribes. SBA may award a sole source 8(a) contract to a Participant concern owned and controlled by an Indian tribe or an ANC where the anticipated value of the procurement exceeds the applicable competitive threshold if SBA has not accepted the requirement into the 8(a) BD program as a competitive procurement. There is no requirement that a procurement must be competed whenever possible before it can be accepted on a sole source basis for a tribally-owned or ANC-owned concern, but a procurement may not be removed from competition to award it to a tribally- owned or ANC-owned concern on a sole source basis.

4. What is an Alaskan Native Corporation (ANC)?

ANC Means any Regional Corporation, Village Corporation, Urban Corporation or Group Corporation organized under the laws of the State of Alaska in accordance with the Alaska Native Claims Act, as amended by 43 U.S.C. 1601.

In addition, as defined in federal regulations, a tribally owned business (Concern) means any business (Concern) that is at least 51% owned by an Indian tribe.

An Indian tribe is any Indian tribe, band, nation or other organized group or community of Indians, including any ANC which is recognized as eligible for special programs and services provided by the United States to Indians because of their status as Indians or is recognized as such by the State in which the tribe, band nation, or community resides.
